今天终于把这一篇三方契约整理完了，契约通篇没有标点看着真是费劲。这本契约立于1871年3月7日，内容是关于人寿保险和借款的，其中有三方参与并有2人签字于下方的折页上。整本契约展开约有85*55厘米左右，考虑到契约原本为一式两份（以剪口对齐为证），这一整张羊皮纸算是不小了。由于前些天也收拾了一些早期的羊皮纸契约，感觉相较于17、18世纪时期的羊皮纸，19世纪后的制作工艺有了明显的改善，从纸的韧度、光泽、厚度以及表面的纹理都有很大进步。下面附上这本契约的内容部分及翻译，我把内容分段整理了一下看着比较方便……（估计能坚持看完的人也不会很多……哈哈）

AND WHEREAS by a certain other policy of assurance under the hands of three of the directors of the said Norwich Union Life Insurance Society dated the said Eleventh day of August One thousand eight hundred and sixty and Numbered 6035, the sum of one hundred pounds is assured to be paid to the executors, administrators or assigns of the said William Stephens at the expiration of three calendar months next after satisfactory proof of his death subject to the annual premium of Four pounds and ten shillings and ten pence,

AND WHEREAS the said William Stephens and also the said Elizabeth Evans have requested the said Hannah Harris to lend to the said William Stephens the sum of seventy pounds which the said Hannah Harris has agreed to do upon having the repayment thereof with interest secured to her in manner hereinafter expressed.

NOW THIS INDENTURE WITNESSETH that in pursuance of the said Agreement and in consideration of the sum of Seventy pounds now paid to the said William Stephens by the said Hannah Harris, the receipt whereof the said William Stephens doth hereby acknowledge and from the same doth release the said Hannah Harris, her heirs, executors, administrators and assigns the said William Stephens doth hereby assign unto the said Hannah Harris, her heirs, executors, administrators and assigns the Several Policies of Assurance on the life of the said William Stephens hereinbefore mentioned and described and several moneys by and to become payable under or by virtue of the said Policies respectively, AND all the Estate right like interest claim and demand whatsoever of the said William Stephens in or to the said Policies, moneys and premises and every of them and every part thereof Together with power to ask demand sue for, recover and receive and give effectual releases and discharges for the said monies in the name or names of the said William Stephens, his executors or administrators or otherwise TO HAVE, hold, receive, take the said policies, moneys, premises hereby assigned or expressed so to be unto the said Hannah Harris, her executors, administrators and assigns subject to the proviso hereinafter contained.

PROVIDED ALWAYS And it is hereby agreed and declared that if the said William Stephens, his executors or administrators or the said Elizabeth Evans, her executors or administrators or either of them shall on the Seventh day of September next pay to the said Hannah Harris, her executors or administrators or assigns, shall upon the request and at the cost of the said William Stephens, his executors or administrators or assigns assign the said policies, moneys and premises hereby assigned or expressed so to be unto the said William Stephens, his executors or administrators or assigns or as he or they shall in that behalf direct AND the said William Stephens and Elizabeth Evans do hereby for themselves and each of them doth hereby for himself and herself his and her heirs, executors and administrators covenant with the said Hannah Harris, her executors or administrators or assigns in manner following that is to say that they the said William Stephens and Elizabeth Evans or one of them or the heirs, executors or administrators of them or one of them shall and will on the Seventh day of September next pay to the said Hannah Harris, her executors, administrators or assigns the sum of Seventy pounds with interest for the same after the rate of Five pounds per centum per annum computed from the date of these presents. And if the said sum of Seventy pounds shall not be paid on the seventh day of September next then shall and will pay unto the said Hannah Harris, her executors, administrators or assigns interest after the rate aforesaid on the said principal sum or on so much thereof as shall for the time being remain owing by equal half yearly payments on the Seventh day of September and the Seventh day of March in every year until the said principal sum shall be full paid.

AND ALSO that he the said William Stephens shall not nor will do any act or commit any default whereby the said Policies of Assurance hereby assigned or any of them may be rendered void or voidable or an increased premium thereon become payable.

And in case the said Policies or any Policy or Policies to be effected as hereinafter mentioned shall by any means become void the said William Stephens and Elizabeth Evans or one of them or the heirs, executors, administrators of them or one of them shall and will forthwith at his, her or their own cost effect a new Policy or Policies on the life of the said William Stephens in view of such void Policy or Policies in the name or names of the said Hannah Harris, her executors, administrators or assigns and in some office to be approved of by her or them in a sum or sums of not less in amount than the sum or sums assured by the Policy or Policies which shall have become void as aforesaid (including any bonus or bonuses which may have been declared thereon) and shall and will duly and regularly pay the premiums and other sums of money (if any) which shall from time to time become payable for keeping on foot the said Policies hereby assigned or any of them or any new Policy or Policies so to be effected as aforesaid and deliver to the said Hannah Harris, her executors, administrators or assigns the receipt for every such premium within seven days after the same shall have become due. 如果上述任何需按以下规定执行的保单由于任何原因失效，威廉·斯蒂芬斯和伊丽莎白·伊万斯两人、或任何其中一人、或他们的或其中一人的继承人、遗嘱执行人、财产管理人应鉴于失效保单，立即自费为威廉·斯蒂芬斯开具新的寿险保单，以保证汉娜·哈里斯、她的遗嘱执行人或财产管理人或财产受让人的利益，开具保单的保险机构也应得到她或他们的认可，新立保单的保金额度应与失效保单的保金额度相同（包括保单可能声明给出的任何红利），并应主动定期及时缴纳保费及其他款项（如果需缴纳其他款项），以保证所有保单不至失效，直至以上述方式得到执行，并将每期保费收据在应缴日期的7天之内发送给汉娜?哈里斯、她的遗嘱执行人或财产管理人或财产受让人。
And in case default shall be made by the said William Stephens and by the said Elizabeth Evans respectively and their respective heir, executors or administrators and every of them in keeping on foot the said Policies hereby assigned or any of them or in effecting or keeping on foot any new Policy or Policies or in delivering any receipt in manner of the said then and in every such case it shall be lawful for the said Hannah Harris, her executors, administrators or assigns to keep on foot the said Policies or any of them or to effect or keep on foot such new Policy or Policies as the case may require if she or they shall think fit so to do.

AND in that case the said William Stephens and Elizabeth Evans or one of them or the heirs, executors or administrators of them or one of them will on demand repay to the said Hannah Harris, her executors, administrators or assigns all the moneys paid by her or them in or about the keeping on foot of the said Policies or any of them or the effecting and keeping on foot such new Policies or Policy as aforesaid with interest for the same respectively after the rate aforesaid to be computed from the time or respective times of paying or advancing the same. And that such monies and interest shall in the meantime be charged on the Policies of Assurance for the time being subject to this security in addition to the said principal sum of Seventy pounds and the interest thereof.

AND it is hereby agreed and declared that every or any new policy to be effected as aforesaid shall be subject to the same right of redemption as the Policy for which the same shall be substituted. AND the said William Stephens doth hereby for himself, his heirs, executors and administrators further covenant with the said Hannah Harris, her executors, administrators and assigns that he the said William Stephens now hath good right to assign the said Policies of Assurance hereby assigned or expressed so to be unto the said Hannah Harris, her executors, administrators and assigns in manner aforesaid free from incumbrances. AND MOREOVER that he the said William Stephens and his executors and administrators and all other persons having or lawfully or equitably claiming any interest in the said Policies and premises hereby assigned or expressed so to be or any of them or any part or parts thereof will from time to time upon the request of the said Hannah Harris, her executors, administrators or assigns and at the cost during the continuance of this security of the said William Stephens, his executors, administrators or assigns and afterwards of the person or persons requiring the same do and execute or cause to be done and executed all such acts, deeds and things for further and more perfectly assigning and assuring of the said Policies and premises respectively unto the said Hannah Harris, her executors, administrators and assigns in manner aforesaid as shall or may be reasonably required.

AND it is hereby agreed and declared that it shall be lawful for the said Hannah Harris, her executors, administrators or assigns at anytime or times without any further consent on the part of the said William Stephens to sell the Policies and premises hereby assigned or expressed so to be and also any new Policy or Policies to be effected as aforesaid or any part or parts thereof respectively either by Public Auction or Private Contract and either together or in lots and either with or without special conditions or stipulations relative to Title or otherwise to any person or persons, company or companies (including the Company or Society with which any such Policy is or shall be effected) with power for the persons or person selling as aforesaid to buy in the same or any of them at any Sale by Auction or to rescind any Contract for the Sale thereof and to resell the same from time to time without being answerable for any loss or diminution in price. And with power also to execute assurances, give effectual receipts from the purchase money and do all other acts and things for completing the Sale which he or they may think proper.

AND it is hereby agreed and declared that the person or persons selling as aforesaid shall with and out of the moneys to arise from any such Sale in the first place pay and retain the costs and expenses attending such Sale or otherwise incurred in relation to this security and shall in the next place pay and satisfy the money which shall then be owing on the security of these presents and shall pay the surplus (if any) unto the said William Stephens, his executors, administrators or assigns.
经双方同意，特此声明如下，以上述方式出售保单和房地产的个人应首先用出售所得钱款还清售卖活动的费用和因保险条款产生的费用，然后付清本契约文件所涉保险当时应缴费用，最后将余款（如有余款）付给威廉·斯蒂芬斯、他的遗嘱执行人、财产管理人或财产受让人。
PROVIDED ALWAYS and it is hereby agreed and declared that the power of Sale hereinbefore contained shall not be exercised unless default shall be made in payment of the said principal sum of Seventy pounds or the interest thereof or some part thereof respectively on the said Seventh day of September next and also for the space of Three calendar months next after a Notice in writing requiring such payment shall by and on the part of the said Hannah Harris, her executors, administrators or assigns have been given to the said William Stephens or left at his usual or last known place of abode in England or Wales or unless default shall be made in some half in some half yearly payment of interest or some part thereof for the space of three calendar months after the time hereby appointed for such payment or unless default shall be made in the observance or performance of any of the Covenants hereinbefore contained in relation to the said Policies of Assurance hereby assigned or expressed so to be or any of them.

PROVIDED ALSO and it is hereby declared that no Purchaser upon any Sale under the power hereinbefore contained shall be bound or concerned to be or enquire whether any such default has been made or whether any such Notice has been given or left or affixed as aforesaid or otherwise as to the necessity or propriety of such Sale or be affected by Notice that no such default has been made or Notice given or left or affixed as aforesaid or that the Sale is otherwise unnecessary or improper.

PROVIDED ALWAYS and it is hereby also agreed and declared that any neglect or forbearance of the said Hannah Harris, her executors, administrators or assigns in endeavouring to obtain payment of the principal moneys and interest intended to be hereby secured or in putting in force any of her or their remedies for the same and any time which may be given by her or them to the said William Stephens, his executors or administrators or to the said Elizabeth Evans, her heirs, executors or administrators shall not in any way prejudice or affect the joint and several covenants hereinbefore contained or the continuing liability of the covenanting parties or any of them by virtue thereof any rule of Law or Equity to the contrary notwithstanding. IN WITNESS whereof the said parties hereto have hereunto set their hands and seals the day and year first above written.
